Well, Joe Biden is at it again—thinking his pen and a podium are all it takes to rewrite the U.S. Constitution. On Friday, during what was supposed to be a farewell ceremony for a military commander, Biden went off the rails (again) and declared the Equal Rights Amendment (ERA) the “28th Amendment to the Constitution.” He even shouted, “It is the law of the land now!” Uh, no, Joe. That’s not how any of this works. Apparently, basic civics wasn’t on the curriculum when Joe was plagiarizing his way through law school.
Biden thinks he can unilaterally declare a 28th Amendment to the Constitution — which, of course, he can't do because it wasn't ratified in time. pic.twitter.com/q0VloRY0JA

Here’s the deal: the ERA, which was introduced in 1923 and passed by Congress in 1972, aimed to guarantee equal legal rights regardless of sex. Sounds harmless enough, but the amendment didn’t clear the finish line because it failed to meet the ratification deadline set by Congress. Let me put it in terms even Biden might understand: you can’t extend your deadline on a term paper after it’s already past due. Oh, and five states even rescinded their ratifications, making this whole thing as dead as Biden’s campaign promises about “unity.”
So now, Biden and Kamala Harris are out here playing constitutional fan fiction, pretending they can just declare the ERA part of the Constitution. Sorry, Joe, but unless you’ve got a DeLorean and 1.21 gigawatts to zap yourself back to the 1970s, you can’t rewrite history. Ratification deadlines matter, and so does the process. Biden saying it’s the law of the land doesn’t make it so—just like him whispering into a mic doesn’t make him look competent.
Even CNN—yes, CNN—had to pump the brakes on this nonsense, noting that legal experts are raising serious questions about the legitimacy of this stunt. The archivist of the U.S. hasn’t certified the amendment, and courts are likely to strike down any attempt to retroactively revive it. In other words, this is headed straight for a legal showdown. So, grab your popcorn, because watching Biden try to explain this in court will be a comedy show for the ages.
Meanwhile, Kamala chimed in to echo Biden, calling the ERA the 28th Amendment. Sure, Kamala. Just like you’re the “Border Czar,” right? The truth is, this administration doesn’t care about the rule of law—they care about performative politics. Biden isn’t enforcing the Constitution; he’s embarrassing it. If the ERA is going to be ratified, it needs to follow the actual process, not Biden’s half-baked executive decree.
