Attorney Mike Davis, founder of the conservative Article III Project (A3P) and a fierce defender of President-elect Trump, has issued a scathing warning to Judge Juan Merchan and Democrat prosecutors, accusing them of engaging in politically motivated “weaponized lawfare” against Trump. Davis’s remarks come on the heels of Trump’s sentencing on Friday, where Manhattan Judge Juan Merchan delivered an “unconditional discharge” for Trump’s conviction on 34 felony counts related to alleged hush money payments to Stormy Daniels during the 2016 election.
Though Trump will face no jail time, fines, or probation, Democrats and their media allies are already seizing the opportunity to brand him as the first U.S. president-elect to be sentenced for a felony conviction—a label they’ll surely use to tarnish his presidency. Trump has consistently denounced the charges as a politically charged “witch hunt” designed to damage his public image and block his return to the White House.

“As the American People have seen, this ‘case’ had no crime, no damages, no proof, no facts, no Law, only a highly conflicted Judge, a star witness who is a disbarred, disgraced, serial perjurer, and criminal Election Interference,” Trump said in a statement. He vowed to appeal what he described as a “despicable charade” and restore public trust in the American legal system.
Mike Davis, a former Chief Counsel for Nominations to Senate Judiciary Chairman Chuck Grassley, didn’t mince words when speaking to political commentator Benny Johnson. Davis pledged relentless advocacy for a criminal investigation into Judge Merchan and other Democrats he accused of abusing their power.
“I’m glad the Democrats had their cathartic sentencing today because it is going to backfire—and backfire spectacularly,” Davis declared. “On January 20th at noon, they’re going to become the hunted. I’m going to make d**n sure of that as a private citizen at the Article 3 Project.”
Davis argued that Judge Merchan and others involved in prosecuting Trump could face serious legal consequences under 18 U.S.C. Section 241, which deals with “Conspiracy Against Rights.” This federal civil rights felony prohibits conspiring to deprive individuals of their constitutional rights. Davis contends that weaponizing the legal system to target Trump for “non-crimes” falls squarely under this statute. “Judges are not immune from 18 U.S.C. Section 241,” Davis warned.
He further accused Judge Merchan of corruption, pointing to his adult daughter, Lauren Merchan, who allegedly profited from Democrat-aligned political work while her father presided over Trump’s case. Davis labeled Merchan and other prosecutors like Alvin Bragg and Letitia James as “stooges” used by Democrats to sabotage Trump’s political comeback.
As Trump prepares to take office, Davis made it clear that he will lobby aggressively for a criminal probe into what he sees as one of the most blatant abuses of the justice system in American history. This bold declaration sets the stage for a high-stakes showdown between Trump’s incoming administration and the Democrats who have spent years trying to take him down.
